By downloading, installing, or using FaceCommand ("the Software"), you agree to these Terms of Service ("Terms"). If you do not agree, do not download, install, or use the Software. These Terms constitute a binding agreement between you and FaceCommand ("we," "us," or "our"), located in Elk Grove, California, USA.
A personal license grants you a non-exclusive, non-transferable, non-sublicensable right to install and use FaceCommand on up to two (2) computers simultaneously for personal or internal business use. You may not:

The free trial allows full use of FaceCommand for seven (7) days from first launch. No credit card is required. After the trial period, a license must be purchased to continue using the Software. We strongly encourage you to evaluate the Software during the trial before purchasing.
All purchases of FaceCommand are processed by Lemon Squeezy, our Merchant of Record. When you purchase a license, your contract for payment and taxes is with Lemon Squeezy (Lemon Squeezy, LLC), and the charge on your card or bank statement will appear as "Lemon Squeezy" or "LEMONSQUEEZY.COM."
Lemon Squeezy is responsible for handling payment, billing, tax collection and remittance, fraud prevention, and initial transaction support. Your use of Lemon Squeezy's checkout is also governed by Lemon Squeezy's own terms of service and privacy policy, available at lemonsqueezy.com.
Prices are listed in U.S. Dollars (USD). Applicable taxes (VAT, GST, sales tax) may be added at checkout depending on your location and are collected by Lemon Squeezy.
We offer a 14-day money-back guarantee. If the Software doesn't work for you, you may request a refund within 14 days of purchase by emailing support@facecommand.net. Full details are in our Refund Policy. Refunds are issued by Lemon Squeezy back to your original payment method.
Your license includes free software updates for the life of the product. Updates may add, modify, or remove features. We will not materially reduce the functionality you paid for without offering a refund or equivalent replacement.
You agree not to use FaceCommand for any unlawful purpose, in violation of any applicable law, or in a manner that could damage, disable, or impair the Software or any system it runs on.
FaceCommand is a general-purpose assistive input device. It is not a medical device and has not been evaluated or approved by the U.S. Food and Drug Administration or any other regulatory body. It does not diagnose, treat, cure, or prevent any disease or condition. Do not rely on FaceCommand for medical, emergency, or life-safety purposes.
FACECOMMAND IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR WILL MEET YOUR SPECIFIC REQUIREMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FACECOMMAND'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SOFTWARE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR LICENSE IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
These Terms remain in effect until terminated. We may terminate your license if you materially breach these Terms. Upon termination, you must cease all use of the Software and uninstall it. Sections 8, 9, 10, 12, and 13 survive termination.
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Sacramento County, California, and you consent to the exclusive jurisdiction of those courts. Nothing in this section limits any mandatory consumer-protection rights you may have under the laws of your country of residence.
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Continued use of the Software after changes take effect constitutes acceptance of the updated Terms.
